סימן קלג סעיף כד
זְמַן תְּפִלַּת נְעִילָה הוּא, כְּשֶׁהַחַמָּה הִיא בְּרֹאשׁ הָאִילָנוֹת, כְּדֵי שֶׁיַשְׁלִים אוֹתָהּ עִם צֵאת הַכּוכָבִים. וְלִפְעָמִים נִמְשֶׁכֶת קְצָת בְּתוֹךְ הַלַּיְלָה, וַאֲפִלוּ הָכִי אוֹמְרִים חָתְמֵנוּ, לְפִי שֶׁאֵין הַדִּין מִסְתַּלֵּק עַד שֶׁיִגְמְרוּ יִשְֹרָאֵל אֶת סִדְרֵיהֶם לְמָטָּה. וְהֶחָרוּז:הַיוֹם יִפְנֶה וְכוּ', אִם יָצְאוּ הַכּוֹכָבִים, לֹא יֹאמַר כֵּן, מִשּׁוּם דַהֲוֵי דּוֹבֵר שְׁקָרִים. אֶלָּא יֹאמַר, הַיּוֹם פָּנָה, הַשֶּׁמֶשׁ בָּא וּפָנָה. שְּׁלִיחַ הַצִּבּוּר אוֹמֵר בִּרְכַּת כֹּהֲנִים וְשִׂים שָׁלוֹם, אַף עַל פִּי שֶׁהוּא לָיְלָה.
The time for beginning the Ne'ilah service is when the sun is over the tree-tops,22This is shortly before the beginning of sunset. so that you will conclude it when the stars begin to appear. Sometimes, the Ne'ilah service is drawn out into the night, but even so, you may say Chosmeinu [seal us], because the heavenly judgment is not concluded until Yisrael concludes the order of prayers below. If the stars have already come out the verse Hayom yifneh [The day is drawing to a close] etc. should not be said, because you would be speaking an untruth. You should say, instead, Hayom panah [the day has ended], hashemesh bo ufanah [the sun has set]. The Chazzan says Birkas Kohanim and Sim shalom, even though it is already night.
